NLRB elections are very similar to other elections: There must be no electioneering around the poll. Votes cast by those who are drunk or coerced are invalid. The list of employees constitutes the poll list. Both sides may have watchers.

It is important for every eligible employee to vote because a simple majority of those who actually vote determines the result. Example: If 200 people are eligible to vote, and only 10 do vote, and of those 10, 6 vote for the union, the union wins. This means the union will represent all 200. Everyone should vote. In this example, each union vote was worth 20 votes because of those who failed to vote.

"Continuing with all of the criteria list in the above sections, the ballot lists a choice for each union claiming majority status in the bargaining unit and for “no union.” Parties are permitted to have observers at the polling places, but neither supervisors nor non-employee union representatives may be present during the balloting. All elections are by secret ballot. Either the Board agent or authorized observers may, for good cause, challenge the eligibility of any voter. Persons challenged are permitted to vote, but their ballots are impounded by the Board agent and are not considered further unless their number is sufficient to affect the results of the election.
