The number one maxim of union avoidance is, "you cant lose an election you dont have." Unions have a right to try to organize dissatisfied employees so the goal of your anti-union efforts is to use legal pro-active prevention activities. Only the constraint of space prohibits me from listing all the things you could and should do. The entire arsenal however is available in our "Complete Union Avoidance Manual."
Many people in management get tired of dealing with other people properly so they never get around to do what they're paid to do. Well, wake up now because when unions begin to organize your company, they'll succeed where you've failed. A primary union deterrent therefore is best explained by James W. Wimberly Jr., the distinguished Atlanta-based labor attorney and senior partner of Wimberly, Lawson, Steckel, Nelson & Schneider, P.C. - Terminated employees or strangers talking with your employees after work.
- Union leaflets in trashcans or littering the parking lot.
- Groups of employees act nervously or stop talking when supervisors approach.
- Employees suddenly begin asking questions about company policies, wages, fringe benefits, and working conditions and how the Company feels about Unions.
- Increased trips to the restrooms during work.
- Increased complaints to governmental regulators.
- An effort by employees to get names or addresses of other workers.
- Increased unrest and outspokenness from workers regarding major changes.
